                               2009 SHELLFISH REGULATIONS
                                      FOR PLYMOUTH, MA

GENERAL REGULATIONS:
Non-Criminal Disposition of Violations
Anyone violating any provision of these Shellfish Regulations shall be subject to a penalty of $50.00 for each first offense, $100.00 for each second offense, and $100.00 and loss of permit for one year for each third offense.  A permit may be revoked at any offense at the discretion of the Harbormaster.
Each violation of each provision shall constitute a separate offense.  For continued violations, each day or portion thereof during which a violation is continued shall constitute a separate offense.
The regulations may be enforced by the Harbormaster, Assistant Harbormasters, or Shellfish Officers.
The signed permit must be kept on the person of anyone in the act of harvesting shellfish.  This permit must be shown upon demand to the Harbormaster, Assistant Harbormasters or Shellfish Officers.
Any shellfish harvested must be shown upon demand to the Harbormaster, Assistant Harbormasters or Shellfish Officers for inspection.
All shellfish must be dug with conventional tined tools.  No shovels are permitted and digging must be by hand without the assistance of any type of power or machinery.
It is prohibited to dig for any shellfish in grass or close to roots of marsh.
It is unlawful to remove the shells from the shellfish before leaving the digging area.
All holes must be filled in by the digger.
No container larger than 10 quarts is allowed on shore, creek or inlet.
Permits are required for all persons over the age of 14.  Those 14 and under must be accompanied by a permit holder whose limit is not increased by the presence of the child.
It is unlawful for a person to harvest any part of another’s limit.
The season for softshell clams, quahogs, razor clams and mussels is April 1-May 31 and September 1-October 31, 2009.
The harvesting of soft shell clams, quahogs, mussels and razor clams shall be on Wednesdays and Saturdays, with the week beginning on Sunday, and shall be done between the hours of one half hour before sunrise and one half hour after sunset.
Soft shell clams, quahogs, mussels, and razor clams are limited to 6 quarts per week per license.  The total amount harvested shall not exceed 6 quarts in any one day and no more than 6 quarts in any one week.
Soft shell clams and quahogs are limited to a minimum size of 2” (inches) or greater.
When harvesting sea clams the limit shall be 24 clams per tide per license.
Sea clams may be harvested year round, any day of the week with the week beginning on Sunday.
Digging of shellfish in not permitted when the air temperature is below 32’F.
No shellfish taken on non-commercial permits may be sold, wasted or bartered in any manner.
The taking of shellfish is prohibited in all contaminated areas. The holder of any permit issued for digging and taking shellfish shall at all times conform to the following regulations and to the provisions of Chapter 130 of the M.G.L. and any subsequent amendments thereto.
